APPLYSTEAD TERMS OF SERVICE

How we work for you.

Version: applystead-terms/v1 · Effective: October 22, 2026

These terms are an agreement between you and Royper Royco LLC, doing business as Applystead, at 3903 South Congress Avenue, P.O. Box 40633, Austin, TX 78704 ("Applystead", "we", "us"). They apply to applystead.com, the Applystead apps and every application we prepare or send for you. Our Privacy Policy explains the information we hold. By creating an account, uploading a résumé, confirming your setup or turning on Auto apply, you accept these terms.

1. Your account

You must be 18 or older and use one account in your own name. You are responsible for the accuracy of the facts and documents you give us and for keeping your sign-in secure. A plan is needed to use the service; current pricing and the terms shown before checkout apply. You can export or delete your account at any time from Account.

2. What you authorize us to do for you

When you upload your résumé or confirm your setup, you authorize Applystead to act for you in your job search. Within the search you saved, that means we may:

If your account is on Auto, we send each application that matches your saved search without asking you again. If your account is on Manual, we prepare each application and send it only after you choose Apply or swipe right. You can switch modes at any time.

3. Applications, corrections and errors

Employer systems fail, forms change, and we make mistakes. You authorize us to hold an application while we fix a cause, to correct and submit again only when we can confirm the employer never received it, and to record an outcome from the employer's own confirmation. We never send the same application twice when we cannot tell whether the employer received it; we investigate first. An application may be delayed, rejected or not received, and we do not guarantee a submission, an interview or a job. A complaint or dispute about a specific application is handled under section 14.

4. Your information and answers

Your facts come from you. Where you have not answered a question, we use the defaults described in the Privacy Policy, and voluntary self-identification questions take the form's decline choice unless you answered them. You can change any fact in Account or Your answers; a change applies to applications prepared from then on. You must not give us another person's information or ask us to apply for someone else.

5. Employer sites and other third parties

Employers and their application systems are not ours. Their terms, their questions and their decisions are theirs, and we accept their terms for you as section 2 describes. We are not responsible for an employer's site, conduct, hiring decision or use of what you send. Nothing in these terms makes an employer our agent.

6. Email, replies and forwarding

Applications are sent from the Applystead address on your account. Employer replies are forwarded to the email address on your account while your plan is active. A reply you send back from a forwarded copy goes to the employer from your Applystead address. Do not use the service to send unlawful, abusive or misleading mail.

7. Payments, trials and cancellation

Prices, billing periods, trials and cancellation are shown on Pricing and in Membership before you pay. Cancel before a renewal to avoid the next charge. Refunds follow the refund policy, and a guarantee is available only where its terms are shown. Cancelling ends your plan; it does not retract applications already received by employers.

8. Acceptable use

Do not use Applystead to break the law, to apply for jobs you are not eligible to hold, to impersonate anyone, to probe or overload our service or an employer's, or to build a competing dataset from our content. We may suspend an account that does.

9. Our content and yours

Applystead, its software, guides and generated documents are ours or our licensors'. You keep your own information and grant us the limited license needed to prepare and submit applications for you and to operate the service. A tailored résumé or answer we generate for one application may be used for that application.

10. Suspension and termination

You can stop using the service or delete your account at any time. We may suspend or end access for a material breach of these terms, for non-payment, or where the law requires it. Sections that by their nature survive termination (including 3, 9, 12, 13 and 14) continue to apply.

11. Disclaimers

The service is provided as it is. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that a particular employer, application system or job will be available, that an application will be received, or that you will receive a reply, an interview or an offer. Nothing in these terms excludes a warranty or right that cannot be excluded by law.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, opportunities or data. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, or a liability that cannot be limited by law.

13. Governing law and where disputes are decided

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and Applystead agree that any dispute about these terms or the service will be brought only in the state or federal courts located in Travis County, Texas, and each of us consents to those courts' jurisdiction. Either of us may bring an individual claim in small-claims court instead. If you live outside the United States, this clause does not remove any protection given to you by the consumer law of the country where you live.

14. Arbitration

Before filing a claim, send a written notice to hello@applystead.com and wait 30 days. If the dispute is not resolved, either party may require it to be decided by one arbitrator under the AAA Consumer Arbitration Rules, seated in Austin, Texas, in English. Each of us waives any right to bring or join a class action. You may opt out of arbitration by emailing hello@applystead.com within 30 days of accepting these terms. Small-claims claims and claims for injunctive relief to protect intellectual property stay in court. If the class-action waiver is unenforceable, this arbitration section does not apply and the dispute goes to the Travis County courts in section 13.

15. Changes to these terms

We may update these terms. A material change is shown in the app before it takes effect, with its new version and effective date, and the version you accepted is recorded on your account. Continuing to use the service after the effective date accepts the new version; if you do not accept it, stop using the service and cancel your plan.
